NOTE: The following items need special attention:

SB1455 – Student opt-out bill
The motion to reconsider has carried, meaning that a second vote may be taken in the Senate. As of this writing, a vote has not been scheduled yet. We need to contact all senators and request that SB1455 be brought up for a vote, and we also need to request that senators vote yes.
 
HB2478 – NOW: qualifications, county school superintendents.
(A strike-all bill). This is a very simple bill. It simply removes the requirement that a county superintendent has to be a certified teacher. We want the most qualified persons and the most likely to represent the voters to hold those jobs. It does not entail classroom teaching, so the requirement does not make any sense. It just cleared Senate COW and is awaiting 3rd reading vote. Please contact all senators and request a yes vote on HB2478.
 
HB2402 – Bonds, Disclosure, Notice
A common sense bill that simply requires that the cost of bond issues be disclosed to voters. Who could possibly oppose advising customers of the cost so that they may make a wise purchase? The amendment in the senate did not significantly affect the intent of this bill. It is now awaiting action in the house. Please contact representatives and request they vote yes on HB2402

INFORMATION ON EDUCATION RELATED LEGISLATIVE BILLS SB1010, SB1351, SB1455, SB1416

Important information on SB1010, SB1351, SB1455, SB1416
SB1010  recycled materials report; state agencies
This is a strike-all bill and now has nothing to do with recycled materials. As amended, it allows the sharing of some student personally identifiable information to be shared with third parties without parental consent. It was HELD in the House Government and Higher Education Committee, but it will probably surface again soon. This is big business for some corporations and as a result they are lobbying feverishly to get this passed. As usual, many legislators will rather hurt students than lose their big corporate funding. It is up to you the people to let them know that you mean business when you call for this bill’s demise in its current form. To read the offending amendment, click HERE
Please contact all representatives and request a NO vote on SB1010, unless it is fixed to require parental approval for any release of student personally identifiable information to third parties.

SB1351  schools; elections; ballot arguments; exclusion
As submitted, this was a great bill dealing with information placed on the information pamphlets distributed to voters regarding bond issue elections. It would have allowed governing board members to omit their name from the PRO argument if they were not in favor of the bond issue. As amended, this bill does the opposite. It effectively hides from voters any hint that there was any opposition by any board member to the request for additional bonds.. To read offending amendment, click HERE
Please contact all representatives and request a NO vote on SB1351, unless the original language is restored. All contact methods are available as of now (e-mail, phone, fax, and RTS). If you rendered a “pro” vote on the RTS, based on the original language, please update it to “against”.

SB1455  students/parents opt-out bill.
This is a strike-all bill with the contents of the old HB2056, parental right opt-out affirmation that was killed in the House Education Committee by Rep. Boyer. It recently failed in the full Senate 3rd reading. However, Sen. Begay may be requesting, and possibly obtaining, reconsideration of SB1455 in the very near future. Like many other education related bills, there is big money involved here, mainly from student test peddlers. It is not a partisan issue; many Republicans voted against it. However, Democrat parents should also be appalled at the prospect of not having control over what happens to their children in school.
Please continue to contact both Republican and Democrat senators via e-mails, phone, and fax, and request that they support SB1455.

SB1416  state board; superintendent; powers; duties
This bill represents the third component of a concerted effort to undermine the only direct voice that citizens have at the State Board of Education. First they tried to recall the current SPI because she stood up for us. Then they tried to make the office of the SPI an outright appointed position. Now they are trying to take away whatever little power the elected SPI has left. Who are “they”? They are a bunch of high level politicians and powerful special interests that want to have absolute control over education issues and can not tolerate even the low level of influence that citizens now have via the ballot box. SB1416 has not been officially scheduled for action in the House, but there is plenty of evidence that it will be.
Please continue to contact legislators via e-mails, phone, and fax, and request that they oppose SB1416. Be ready to express opposition via the RTS as soon as it is scheduled for committee hearings.

AZ Senate: Parental Opt-Out bill fails, Ballot Harvesting bill still in play

SB1455 The parent/student opt out bill
This bill has FAILED in the senate 3rd reading 11-18-1. It failed because 7 Republicans joined all Democrats in voting against it. The 7 Republicans were Kavanagh, Pierce, Driggs, Lesko, Begay, Dial, Worsley.
You may be well advised to remember these senators’ votes when they request your assistance with their reelection.

HB2023 The bill aimed at reducing ballot harvesting
This bill is still in play and it may come up for senate votes this week. THE RTS COMMENTS ON THIS BILL HAVE BEEN RUNNING ABOUT 40% FOR AND 60% AGAINST. If we expect senators to vote in favor of this important bill, we have to do a lot better than we have been doing so far. Clearly the other side is cleaning our clock on this. But there is still time. It is still scheduled for a Rules committee hearing, which means RTS comments are still allowed. This is the action that we are recommending:

  1. First, make up your mind that the issue of ballot harvesting is important to you. Then…
  2. Call, e-mail, or fax every senator, requesting a YES vote on HB2023
  3. Encourage everyone you know to do the same

REQUEST TO SPEAK UPDATE

QUESTION: When a bill clears its first chamber and moves on to the second chamber, do RTS opinions rendered in the first chamber accompany bill to the second chamber?
Efforts to obtain a straight answer from AZLEG IT folks have so far proven unsuccessful. But working with the site, there is every evidence that votes and comments do not carry over. Therefore, that is the position we recommend that everyone adopt for now.
This means that we have to render an opinion again when the bill begins consideration in the second chamber. However, this is not as difficult as it may seem at first. Here is how to do it.

  1. Log in as usual, and click on “new request”
  2. If the blue button at the far right reads “add request”, proceed as usual.
  3. If the blue button at the far right reads “update request”, click on it.
  4. On the screen that comes up, simply click on “update”, and you are done.
  5. However, you may want to take this opportunity to actually change something, like adding or editing comments before clicking on “update”.

The AZ Legislature has taken action on SPI duties, Lawyers Right to Work, Sanctuary Cities, and Municipal Services Cards

Some important bills have seen action this week, including HB2219, SB1017, SB1378, SB1416:

The following bills have been changed substantially from their original form:
HB2088 Via amendments, this bill has suffered a partial testiculectomy, making it not nearly as good as the original
SB1351 The amended Lesko version that came out of COW does the exact opposite of the original bill.

Other significant bills saw action this week as follows:
HB2219 Right to work. This bill would have allowed lawyers to practice without having to join the SBA union. The following Republican representatives joined the Democrats in defeating it: Fann, Townsend, Brophy-McGee, Coleman, Pratt, Robson
SB1017 This bill would have prohibited city services cards to be used as identification, as in voter registration. The following Republican senators joined Democrats in defeating it: Pierce, Yarbrough, Driggs, Worsley.
 SB1378 This bill would have prohibited certain money transfers to cities that engage in sanctuary city activity. Republicans voting against were: Pierce, Driggs, Begay, Worsley.
 SB1416 This bill covers a lot of issues, but it also transfers most of the power of the duly elected Superintendent of Public Instruction to unelected and unaccountable appointed bureaucrats. The following senators voted in favor of the only elected member of the state school board (voted against bill): Donahe, Farnsworth, Shooter, Burges, Smith.
